Terms of service
1.1 This site, www.nandos.com.au (Website), is made available by Nando’s Australia Pty Ltd (Nando's, we, our or us).
1.2 Any reference to Nando's, we, our or us includes our employees, officers, directors, agents and related body corporates.
1.3 These website terms of use (Terms) apply to anyone who uses, accesses, refers to, views and/or downloads (users, you or your) the information we make available on the Website (Content) and the Content provided on the Website (Services).
1.4 You agree that you are solely responsible for obtaining and maintaining all facilities, services, products and equipment that you may need to use and access the Website and the Services. You must provide your own hardware, software (e.g. modem and internet connectivity) and telecommunications infrastructure to use and access the Website and the Services.
2. Your agreement to these Terms
2.1 By continuing to access our Website and/or use our Services you enter a legally binding contract with us on these Terms and our Privacy Policy accessible here (Privacy Policy).
2.2 These Terms, the Privacy Policy and any other documents we incorporate by reference (e.g. terms relating to products ordered online and our loyalty program that are also available on the Website) are the complete and exclusive understanding and agreement between you and us.
2.3 If you do not agree with these Terms, the Privacy Policy or any other documents we incorporate, or any changes to them or the Website, you must stop using the Website and our Services.
2.4 We may change these Terms in our discretion. Each time you use the Website and/or our Services it is your responsibility to stop using the Website and our Services if you do not agree.
2.5 You may print a copy of these Terms. If you have any difficulty printing these Terms, or you need help getting a copy, please contact our Customer Care team on 1300 NANDOS (1300 626 367) or send an email to customercare@nandos.com.au.
3. Accessing and using the Services
3.1 The Website and the Services may contain links to other third-party websites, including social media platforms and forums (Third Party Websites). If you link to Third Party Websites, you will be subject to the terms, conditions and policies of those Third-Party Websites.
3.2 We do not allow copyright infringing activities or infringement of intellectual property rights on the Website. In our sole discretion we may remove any Content we deem infringes on another's intellectual property rights or our own.
3.3 Hyperlinks on the Website to external sites not controlled by us are provided on an "as is" basis and we do not necessarily agree with, edit or sponsor the content on such websites.
3.4 No person, business or website may frame the Website or any pages on the Website in any way.
4. Loyalty program and promotions
4.1 We offer a PERi-Perks loyalty program in Australia (PERi-Perks Program). If you are a member of the PERi-Perks Program and you want to earn loyalty rewards or discounts, please refer to the PERi-Perks Program terms and conditions here (PERi-Perks Program Terms & Conditions).
4.2 We may run competitions and/or promotions from time to time and publish the terms and conditions for them on the Website. By entering or participating in a competition or promotion you agree to be bound by the relevant terms and conditions on the Website at the time. We retain the right to remove, alter or add to competitions or promotions on the Website in line with the terms of any competition or promotion.
5. Ordering catering online
5.1 We offer an online catering order service for our products that is subject to our online catering orders terms and conditions here (Catering Website). By ordering catering and accessing and using the Catering Website you agree to our online catering orders terms and conditions.
5.2 Catering orders placed before 3:00pm Monday to Thursday need at least 24 hours’ notice and for orders placed before 3:00pm Friday to Sunday need at least 48 hours’ notice. For orders over $500 additional minimum notice may be needed based on volume and availability and a representative of ours will contact you if this is needed.
5.3 Payment for catering orders are made through the Catering Website via credit or debit card at the time of placing an order. No order will be processed without payment and no cash payments will be accepted. If a product is out of stock, or your chosen time for pick up is unavailable, a representative of ours will contact you to make alternate arrangements.
5.4 Menu prices and offerings are updated from time to time. Products will be charged at the price applicable at the time you submit your catering order as shown on the invoice.
5.5 The minimum catering order is $60 and the Catering Website will list the applicable minimum and maximum quantities of each product. If you need more flexibility, please call 1300 NANDOS (1300 626 367) and we will try to accommodate your requests.
5.6 If you are not satisfied with an order, please call 1300 NANDOS (1300 626 367) or email catering@nandos.com.au within a reasonable time and provide the full details of what you ordered and why you were unhappy. If you call after business hours, please leave a voicemail message. Once we receive a request, we will raise it with the restaurant that filled the order and, if deemed appropriate by Nando’s in its discretion, arrange a refund or part refund for the unsatisfactory products.
5.7 We do not offer delivery for catering orders. All catering orders must be collected by you from a designated Nando’s restaurant which will be confirmed via telephone, email or directly by the Nando’s restaurant filling the catering order.
5.8 Cancellations of any online catering orders within 24 hours of the scheduled collection time will incur a 50% cancellation fee.
5.9 We will try to honour requests to change any part of a catering order (e.g. adding or deleting products and/or changing the collection time), but we cannot guarantee that the request will be met if received within 24 hours of the scheduled collection time.
5.10 If you use a third party delivery service to collect your catering order, we take no responsibility for the proper handling and storage of the food collected by them (including allergen cross-contamination during delivery). By using a third party delivery service, you acknowledge that the products you consume are your responsibility and you release us from any liability for any illness suffered, or any loss or damage incurred, as a result of your use of a third party delivery service and/or consumption of our products delivered to you by a third party delivery service.
5.11 It is your responsibility to check the food safety stickers on the packaging of your catering order that notes the date the products must be consumed by. We recommend that our products are consumed within 4 hours of the time and date indicated on the stickers.
5.12 By disclosing or submitting your personal information to us when making a catering order, using the Catering Website or creating an account, we will handle the collection, processing, use and storage of your personal information in accordance with our Privacy Policy.
5.13 If you are a PERi-Perks Program member you will receive points for your order if you include your membership number when ordering. Points are not added when you place your order but will be applied to your member account up to 7 days after the order collection date.
6. Ordering products
6.1 All ingredients, products and menu items are subject to availability.
6.2 At Nando’s discretion, menu items may be available at selected restaurants only and/or available through a particular channel only (e.g. dine-in, takeaway and/or delivery).
6.3 All menu items should be consumed responsibly.
6.4 If available, bottomless drinks are restricted to 1 bottomless glass per person per meal for dine-in consumption only.
6.5 Nando’s cannot guarantee that menu items are free from allergens as there is a risk of allergen traces due to cross-contact. You can read Nando’s full allergen information here.
7. Ordering products online
7.1 We provide an online ordering website here (Ordering Website), a link through Nando’s mobile application (App) and a platform for orders placed at tables in our restaurants through the App (OAT) for you to place online orders with us to purchase our products for collection by you, or for delivery to you if ordered through the Ordering Website or the App, from participating Nando’s restaurants (together the Online Ordering Platforms).
7.2 Access to our Online Ordering Platforms
7.2.1 You can access some areas of the Online Ordering Platforms without placing an order or registering your details with us, however by accessing any part of our Online Ordering Platforms, you agree to these Terms and our Privacy Policy.
7.2.2 The version of these Terms published on the Website at any given time are those in full force and effect when you place an order for products through an Online Ordering Platform, which are binding on you when you place an online order.
7.2.3 We make every reasonably and commercially viable effort to ensure that our Online Ordering Platforms are available 24 hours a day and 7 days a week, however we are not liable if our Online Ordering Platforms are unavailable at any time due to planned or unplanned maintenance or for any other reason.
7.2.4 Access may be suspended to the Online Ordering Platforms temporarily at any time without prior notice to you.
7.3 Use of our Online Ordering Platforms
7.3.1 You can use our Online Ordering Platforms for your own personal and non-commercial use only.
7.3.2 You assume full responsibility for any associated costs or charges that you incur by using our Online Ordering Platforms.
7.4 Your information
7.4.1 When you place an order through our Online Ordering Platforms you need to give us personal information, including your full name, email address, delivery address (if you choose delivery for orders made through the Ordering Website or App), mobile phone number and payment information.
7.4.2 Our Privacy Policy governs how we deal with your personal information.
7.4.3 Our PERi-Perks Program Terms & Conditions govern how we deal with your member account if you use the Online Ordering Platforms as a member rather than a guest.
7.5 Placing your online order
7.5.1 Orders you place through our Online Ordering Platforms will either:
a. be collected by you directly at your chosen Nando’s restaurant if you ordered through OAT or if you selected pickup during the checkout process when ordering through the Ordering Website or App; or
b. be delivered to you from your chosen participating Nando’s restaurant if you ordered through the Ordering Website or App and chose the delivery option.
7.5.2 Orders you place through our Online Ordering Platforms can earn PERi-Perks Program points if allowed by the relevant product and offer terms.
7.5.3 Orders you place through our Online Ordering Platforms can apply PERi-Perks Program points to purchases or redemptions if allowed by the relevant product and offer terms.
7.5.4 We can refuse, without refund, orders made by third party delivery services placed via our Online Ordering Platforms.
7.5.5 To place an order via our Online Ordering Platforms, you must:
a. select the participating Nando’s restaurant that you want to collect your order from, or have your order delivered from. Please ensure you have selected the correct restaurant as it cannot be changed once the order has been submitted;
b. select the products you want to order (Order);
c. select your preferred and available collection or delivery method (pick-up for any Order, dine-in for Orders placed through OAT or delivery for Orders placed through the Ordering Website or the App);
d. insert your estimated pick-up collection time or your preferred delivery time;
e. provide your payment information;
f. provide all other requested information to finalise your Order (including offer redemptions, order notes and delivery instructions);
g. accept the opportunity to submit your Order;
h. check all information that you have entered is correct, and if not, correct any errors as they cannot be corrected once we have started processing the Order; and
i. once the Order details are correct, submit your Order.
7.5.6 By placing an Order on the Ordering Website or the App for delivery, you accept that your Order will be fulfilled from either Nando’s or a Nando’s franchisee, depending on your delivery postcode area, and that you enter into an agreement with either Nando’s or a Nando’s franchisee for that Order. If your Order is being fulfilled by a Nando’s franchisee, they will fulfil your Order, and you will find their contact details in the restaurant section, ordering checkout page and confirmation email that you will receive after making your Order through the Online Ordering Platform.
7.5.7 Despite clause 7.5.6, payments made through the Ordering Website and the App are made directly to Nando’s. If your Order is fulfilled by a Nando’s franchisee, Nando’s will remit the required payment for the Order to that franchisee.
7.5.8 Nando’s accepts no liability or responsibility for incorrectly placed Orders or delivery details which are incorrectly supplied, or which you fail to supply.
7.6 Liquor sales
7.6.1 We support the responsible service of alcohol.
7.6.2 It is against the law to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises, or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises.
7.6.3 We do not sell alcohol to people under the age of 18.
7.6.4 We do not sell alcohol to people without the purchase of food in Western Australia.
7.6.5 By using our Online Ordering Platforms, and submitting your Order through our Online Ordering Platforms, you confirm that you are making an offer to purchase, you are over the age of 18, you are the person receiving the alcohol and you are aware of, and will comply with, all relevant laws regarding the purchase and consumption of alcohol.
7.6.6 Liquor sales are available through the OAT for dine-in only, not takeaway or delivery.
7.6.7 You must provide valid identification when offering to purchase liquor, otherwise we will refuse your offer and refund payment for your Order within 7 business days.
7.7 Prices and payment
7.7.1 You will be charged the prices listed on the Online Ordering Platform, including delivery costs where appropriate, which are inclusive of GST.
7.7.2 Prices may vary from time to time and across different ordering platforms including across dine-in, pick up or delivery.
7.7.3 We reserve the right to refuse an Order, or to alter the price if an incorrect price was given due to software malfunction or interference with the Online Ordering Platform.
7.7.4 If your payment is not authorised, we will notify you of this, but your order will not be fulfilled or sent to the chosen Nando’s restaurant.
7.7.5 You must pay for your Order through the Online Ordering Platform using an accepted credit or debit card, Nando’s gift card or PERi-Perks Program points (where permitted by the PERi-Perks Program). Payment via credit or debit card will be debited from your account in the timescales set by your card or account provider.
7.7.6 You are responsible for any associated costs or charges that may be incurred through the payment platform or your card provider by using the Online Ordering Platform.
7.8 Cancelling or changing your Order
7.8.1 You may ask to cancel or change your Order after it has been submitted and payment has been authorised through the Online Ordering Platform for pick-up or dine-in Orders only (expressly excluding delivery Orders) by:
a. calling our Customer Care team on 1300 NANDOS (1300 626 367) and selecting option 2 to be connected to the chosen Nando’s restaurant; and
b. requesting the cancellation or change at least 30 minutes before the chosen collection time.
7.8.2 No refund can be provided if you try to cancel or change your Order within 30 minutes before the chosen collection time or if the Order was made for delivery.
7.8.3 If you successfully cancel or change your Order, your original payment will still be processed, but if you are eligible for a refund you can have this handled by following the refund request process in clause 7.11.
7.8.4 If we are unable to fulfil your Order, or if a product is no longer available, we will contact you either before you collect the Order at your chosen Nando’s restaurant or before your Order is collected from the Nando’s restaurant fulfilling your delivery. We will try to replace the unavailable product with another product of similar or equal value or refund the amount you paid by following the refund request process in clause 7.11.
7.9 Collecting your Order
7.9.1 If you have chosen to collect your Order you must:
a. collect your Order at the chosen Nando’s restaurant and at the nominated time you selected through the Online Ordering Platform;
b. make yourself known to one of the restaurant team members on arrival; and
c. show a valid form of proof of identity on request.
7.9.2 We will try to have your Order ready at the time you chose.
7.10 Delivering your Order
7.10.1 If you have chosen to have your Order delivered, you must be available to accept delivery from your nominated delivery address.
7.10.2 The delivery of your Order will be fulfilled by Door Dash.
7.10.3 We will use reasonable and commercially viable efforts to ensure your Order is delivered in the timeframe you chose, but factors outside our control (including traffic and weather conditions) may prevent on time delivery.
7.10.4 If you cancel your Order after submission, you will be charged the full price for the products if food preparation has started and the full price for delivery if the driver has been dispatched.
7.10.5 You will be charged for failed delivery Orders you caused (including your failure to come to the door or pick up the phone when contacted, you giving the wrong contact or delivery information or where the delivery driver is unable to find a safe location to leave the Order if you fail to come to the door).
7.11 Requesting a Refund
7.11.1 If you are not happy with a product and would like to request a refund, please apply for an automatic refund through the Website or App by following the prompts and meeting the following pre-conditions:
a. available 45 minutes, and up to 7 days, after an order has been placed;
b. a maximum refund amount of $30 (Refund Threshold);
c. available only for orders made at or from participating restaurants in Australia and New Zealand;
d. capped at 2 automated refunds in a 6 month period and 3 automated refunds in a 12 month period per customer within the Refund Threshold;
e. accept the automatic refund payment conditions as follows:
i. if the original payment method was by debit/credit card, the refund will be processed to the original payment method (5-7 business days);
ii. if the original payment method was by PERi-Perks Points, a refund back to the linked PERi-Perks Account (to be reflected in the account within 24 hours);
iii. if the original payment method was by a gift card, a refund back to the gift card (to be issued within 24 hours);
iv. if the original payment method was by a coupon, a refund will be processed as a gift card back to the original email address used to place the order within 24 hours;
v. if the original payment method was by PayPal, a ticket will be lodged with the Customer Care team for follow-up;
vi. if the original payment method was mixed (e.g. part payment using PERi-Perks Points, part payment using a gift card and/or part payment using a debit or credit card), a refund back to the original payment methods in the order of PERi-Perks Points, gift card then debit or credit card will be made; and
vii. if the order is not eligible for a refund for any reason, a ticket will be lodged with the Customer Care team for follow-up.
7.12 Customer service
7.12.1 Customer care is extremely important to us. Our Customer Care team will try to assist you within business hours if you have any problems with your Order through the contact details available on our Website.
7.12.2 We do our best to ensure that our product names, descriptions, prices, nutritional information and allergenic warnings are accurate. If you have any doubt about the contents of our products you should confirm this with your chosen Nando’s restaurant directly before you place your Order.
7.13 Termination of use
7.13.1 We may terminate or suspend your right to use or place orders from our Online Ordering Platforms immediately by notifying you if we believe, in our sole discretion, that you have breached these Terms.
7.13.2 Our products are sold on a direct to customer basis, where the person who places the Order, or uses our Online Ordering Platforms, collects their order in person, or has the order delivered to them, for private consumption.
7.13.3 You are not entitled to re-sell our products ordered through our Online Ordering Platforms for your own commercial gain or use.
8. Gift cards
8.1 We accept no liability for unauthorised acceptance or redemption of our gift cards and reserve the right in our sole discretion at any time to amend the terms of use of our gift cards.
8.2 By purchasing, using or attempting to use our gift cards, or by making a transaction, enquiry or exercising any right to redeem value loaded on our gift cards, you agree to be bound by these Terms. You agree that you will comply with these Terms and all applicable laws.
8.3 If you are giving our gift cards to another person, it is your responsibility to ensure that they are aware of these Terms and that by using or attempting to use our gift cards they are bound by these Terms and must comply with these Terms and all applicable laws.
8.4 The expiry date on our gift cards is 3 years from the date of purchase. After that, any remaining funds on the expired gift card will not be available for redemption.
8.5 Our gift cards cannot be reloaded or recharged with additional value.
8.6 You may use Visa Card, MasterCard or Amex to pay for our gift cards.
8.7 Our gift cards cannot be exchanged for another denomination or tender (e.g. cash or other currency) and cannot be refunded or returned unless required by applicable laws. We are not responsible for, and are not able to replace, gift cards which are lost or stolen.
8.8 Our gift cards can only be used to purchase products available at participating Nando’s restaurants in Australia by presenting the gift card at the time of purchase. The transaction will be completed when the balance has reduced on the gift card. No change will be given. Any remaining balance on the gift card may only be used in whole or in part against a future product purchase at Nando’s. Our gift cards may only be used to make purchases up to the remaining value on the gift card and if a purchase is for an amount exceeding the remaining value on the gift card, you must pay the excess using another approved method of payment.
8.9 Faulty or damaged gift cards are not replaced by us unless they are faulty or damaged due to the production process or fault on our behalf. In this circumstance please contact us on 1300 NANDOS (1300 626 367) or at customercare@nandos.com.au during business hours to discuss replacement options.
8.10 Gift card holders can check the balance of their gift card by requesting the balance amount with staff at any participating Nando’s restaurant in Australia or by contacting us on 1300 NANDOS (1300 626 367) or at customercare@nandos.com.au during business hours.
8.11 Risk and title in a gift card will pass to you on payment for the gift card. We will not be responsible for any unauthorised acceptance or redemption of our gift cards.
8.12 PERi-Perks Program members do not accrue points when purchasing gift cards and do not accrue points when redeeming gift cards on any product.
9. Accuracy of information
9.1 Whilst all reasonable steps and precautions have been taken to ensure the accuracy of the Content on the Website, the Content is intended and produced for general information only and should not be relied upon by you as specific advice of any kind.
9.2 You understand and agree that the information, details and descriptions on the Website (including prices, menus, products and services) may change from time to time and you will be bound by these charges from the date the changes are posted on the Website.
9.3 You understand that any nutritional information on the Website is not intended to, and does not, constitute professional advice or a replacement or substitute for professional advice.
10. Your obligations when using the Website and the Services
10.1 You may not use the Website to obtain or distribute:
10.1.1 copyrighted material or material protected by law without our prior written consent; or
10.1.2 material containing viruses or any other destructive materials, data or code which can corrupt, interfere with, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation of a computer system or hardware or software.
10.2 You must not do anything that may jeopardise or interfere with the functionality or operation of the Website or the Services or any part of the Website or the Services.
10.3 You may not use the Website for "spoofing", "hacking", "flaming", "cracking", "phishing" or "spamming" or any other activity aimed at achieving purposes similar or the same as these acts.
10.4 You may not intercept any information transmitted to or from us or the Website which is not intended by us to be received by you.
10.5 You can only use the Website and the Content for lawful purposes but you may not use of the source code of the Website or the Content in any circumstances.
10.6 You may not frame, modify, distribute, commercialise, exploit and/or alter the Website or the Content, incorporate any part of the Content in any other work or publication and/or perform any other act which may not be considered fair use. On notice from us, you agree to stop any activity which we do not consider, in our sole discretion, to constitute fair use.
10.7 Any restrictions on the use of the Website or the Content also applies to any part of the Website or the Content which may be cached when using the Website or the Content.
10.8 You will not, and will not allow a third party to:
10.8.1 decompile, disassemble or otherwise reverse engineer or attempt to reconstruct or discover any source code, underlying ideas, algorithms, file formats, programming of the software forming part of the Website and/or the Content (Software) or any files contained in or generated by the Software by any means whatsoever;
10.8.2 remove any product identification, copyright or other notices from the Software or documentation; or
10.8.3 download, store or disseminate performance information or analysis of the Software from any source relating to the Software.
11. Intellectual property rights
11.1 We reserve all rights (including intellectual property rights) to the Website and Content we make available on or via the Website.
11.2 You agree not to use, copy or distribute any of the Content other than as expressly permitted in these Terms, including any use, copying or distributing of third-party Content obtained through the Website for any commercial purposes. If you download or print a copy of the Content for your personal use, you must retain all copyright and other proprietary notices.
11.3 You agree not to circumvent, disable or otherwise interfere with security-related features of the Website or features that prevent or restrict use or copying of any Content or enforce limitations on the use of the Website or the Content. All our moral rights and those of our employees and/or agents are reserved.
11.4 Any reproduction, modification or creation of derivative works from, or redistribution of, the Website, the Content or the collective work or compilation is expressly prohibited. Copying or reproducing the Website, the Content or any portion of the Website or the Content to any other server or location for further reproduction or redistribution is expressly prohibited.
11.5 You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes any aspect of the Website, the Content or the Services.
12. Collection of Personal Information
12.1 We collect personal information from you. We will handle the collection, processing, use and storage of your personal information in accordance with our Privacy Policy.
12.2 By disclosing or submitting your personal information to us, you consent to us collecting, processing, using and storing your personal information for the purposes you provided the personal information to us and for those purposes described in our Privacy Policy.
13. Indemnity
13.1 You have certain rights under the Australian Consumer Law which cannot be excluded and are not affected by these Terms. Except for those non-excludable statutory rights, any conditions implied by any other laws are excluded from these Terms.
13.2 To the maximum extent permitted by law, you agree to defend, indemnify and hold us and our officers, employees, agents, related body corporates, successors, assigns, service providers and suppliers harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt and expenses (including solicitors' fees) arising from:
13.2.1 your use of, and access to, the Website, the App, the Content, the PERi-Perks Program, the Online Ordering Platforms and/or the Services;
13.2.2 your violation of any of these Terms;
13.2.3 your violation of any third party right (including any copyright, trademark, trade secret or other property or privacy right); and/or
13.2.4 any claim that the Content caused damage to you or a third party.
13.3 The defence and indemnification obligations referred to in clause 13.2 will survive termination, modification or expiration of these Terms and your use of the Services and the Website.
14. Limitation of liability
14.1 Subject to clause 14.2 below, neither us nor any of our officers, employees, agents, related body corporates, successors, assigns, service providers and suppliers will be liable for any damage, loss or liability arising from your use of, or inability to use, the Website, the Services or the Content, including the App and the Online Ordering Platforms. We make no representations or warranties, implied or otherwise, that the Content and technology available from the Website are free from errors or omissions or that the Services will be uninterrupted and error free.
14.2 No provision of these Terms (or any contract governed by these Terms):
14.2.1 limits or exempts us from liability (including any loss directly attributable to our gross negligence or wilful default) to the extent that the law does not allow such a limitation or exemption; and
14.2.2 requires you to assume risk or liability, to the extent that the law does not allow such an assumption of risk or liability.
15. Exclusion of warranties and representations
15.1 While the products and Services sold via the Website may be subject to the additional payment terms and conditions accessible via the Website, to the maximum extent permitted by law, the Website and the Content are supplied on an "as is" basis and have not been compiled or supplied to meet your individual requirements. It is your responsibility to satisfy yourself before accessing and using the Website or the Services that the Content and the Services will meet your individual requirements and be compatible with your hardware and/or Software.
15.2 To the maximum extent permitted by law, the Website and the Services are provided without any representation or warranty, whether express, implied or statutory, including any representation or warranty as to the operation, integrity, compatibility, availability or functionality of the Website or the operation, accuracy, completeness, integrity, compatibility, availability, functionality or reliability of the Content or the Services.
16. Assignment
16.1 These Terms, and any rights and licenses granted in these Terms, may not be transferred or assigned by you, but may be assigned by us in our sole discretion without restriction. Any assignment or transfer by you shall be null and void.
17. Successors & assigns
17.1 These Terms shall continue for the benefit of, and be binding on, successors and assigns.
18. Violation of Terms
18.1 Please report any violations of the Terms (including the Privacy Policy or any documents incorporated by reference) that you become aware of by contacting us here.
18.2 Any failure by us to act on a breach by you or others does not waive our right to act with respect to subsequent or similar breaches by you or others.

20. Interpretation and miscellaneous provisions
20.1 These Terms and the relationship between us shall be governed and construed in accordance with Australian law. Any disputes arising in connection with these Terms and our Services shall be subject to the exclusive jurisdiction of the courts in the State of Victoria, Australia.
20.2 The termination of any contract created by these Terms will be without prejudice to any other rights or remedies a party has at law, and will not affect any accrued rights or liabilities.
